Stay Proceedings Before High Courts in Matters Challenging IT Rules: SC
Recently the Supreme Court stayed the proceedings of the High Court in matters of Information Technology (IT) Rules.
The Supreme Court has passed an order to stay all proceedings of High Courts on petitions challenging the validity of the following two laws:
- The Information Technology (Intermediary Guidelines And Digital Media Ethics Code) Rules, 2021, and
- The Cable TV Networks (Amendment) Rules,
The Information Technology (IT) Rules, 2021
- These rules are related to due diligence and grievance redressal from intermediaries, including social media and OTT platforms, and the rules of the Ministry of Electronics and Information Technology.
- These empower the users of the digital platform. Also, ensure the accountability of intermediaries for a free, secure and reliable internet.
The Cable TV Networks (Amendment) Rules, 2021
These rules provide a legal mechanism for complaints made by citizens in respect of any material transmission.
They provide a three-tier grievance redressal mechanism-
- self-regulation by broadcasters,
- self-regulation by broadcasters’ self-regulating bodies, and
- Oversight by an inter-departmental committee at the central government level.
- The latest decision of the Supreme Court is in line with Article 139A of the Constitution.
