Delhi NGT is Not Superior To Other Regional Ones

Recently, the Madras High Court has set aside the 2017 Central Notification which had declared the NGT North Zone Bench located in Delhi as the Principal Bench.

It has been described that if the process of transferring the cases to Delhi is followed, it will amount to denial of access to justice.

It held that all the five Regional Benches of the NGT are equally authorized and their orders are applicable throughout India.

The following are the regional benches of NGT- Central Zone (Bhopal), Eastern Zone (Kolkata), Southern Zone (Chennai), Western Zone (Pune) and Northern Zone (New Delhi).

About National Green Tribunal (NGT)

  • Established in the year 2010 as per the National Green Tribunal Act, it is a specialized judicial body with full expertise to adjudicate environmental matters in the country.
  • The NGT is headed by a retired Supreme Court judge.
  • It shall not be bound by the procedure laid down under the Code of Civil Procedure, 1908, but shall be guided by the principles of natural justice.
  • The orders of the Tribunal are binding and have the power to provide relief in the form of compensation and compensation to the affected persons.
